The European Notarial Network (ENN) is a tool for notaries having practical questions with a cross-border element. It covers the 22 EU Member States that have civil law notaries. A contact point is available to help notaries in each of these 22 countries.

As a "one-stop platform", the ENN IT Infrastructure will enable notaries in Europe to:

1. Open an account with secure access (username and password) to the databases and working documents provided by the ENN
2. Develop tools for notarial cross-border practice and for citizens, for example by creating bilingual forms for use in notarial practice
3. Have access to reliable, updated and/or new legal information and to various tools for notarial practice, as well as some tools intended for the public
4. Join specialised networks offering:
   1. An interface with its own thematic forums (discussion groups)
   2. Online communication among members

The website authorises the implementation of a hyperlink to its content, provided the technique of ‘deep linking’ is not used, unless express authorisation has been granted. In other words, the pages of the website (https://www.enn-rne.eu) must not be interleaved in pages of another website but be accessible by opening a window. The source must be mentioned and a hyperlink will point directly to the targeted content. The information is only for personal use or the use of associations or professionals; use for commercial or advertising purposes is not allowed.

This authorisation does not apply to websites that disseminate polemical, pornographic or xenophobic information or information that a majority of people would find offensive.

The applicable law is Belgian law and the Belgian courts are competent in case of dispute.

II. PRIVACY POLICY

The Council of the Notariats of the European Union (CNUE) (“data controller”) respects and is committed to protecting the privacy of notaries in full compliance with the Regulation (EU) 2016/679 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data.

II.1. Collected personal data and origin

Personal data of registered notaries (members) come from members themselves via:

• the registration form (name, surname, address, city, country, language, phone, password, email address)
• the use of video conferencing (image)
• the use of the website (cookies, communications etc.)

Personal data (name, surname, country, city and email address) of European notaries who can be invited come from the European Directory of Notaries.

II.2. Purposes of processing

Personal data are collected and processed only for the purposes mentioned below:

• ensuring the management and control of the execution of the proposed services
• performing statistics
• improving the quality of the website and the services offered by the controller

II.3. Retention period

Personal data of members will be stored until their unsubscribe.

II.4. Lawfulness of processing

The lawful bases under which we process personal data of members are:

• processing using their consent (Art. 6.1.a GDPR): CNUE processes personal data of members to provide and administer services relating to the ENN. This data processing is based on their consent
• processing under contract (Art. 6.1.b GDPR): for necessary cookies

The lawful bases under which we process personal data of European notaries who can be invited are:

• processing is necessary for the performance of a task carried out in the public interest which is stipulated in the statutes of the CNUE (Art. 6.1.e GDPR)

II.5. Recipients

The recipients of the data are the other members of the European Notarial Network and our processors which process personal data of members on behalf of the CNUE.

II.6. Rights and choices

Depending on the lawful bases, members and European notaries who can be invited can have the following rights regarding their personal data:

• the right to withdraw their consent at any time
• the right of access to their data
• the right to correct their data if it is incorrect
• the right to ask for a copy of their data to be transferred to another organization
• the right to ask for their data to be deleted

II.7. Use and management of “cookies”

a) General principles

This article provides information regarding the use of cookies on the website.

This cookie management policy applies to the website. These are managed by the CNUE and Google.

b) Definition of cookies

A “cookie” is a data or text file that a web site server temporarily or permanently stores on the user’s computer equipment (hard disk, tablet, smartphone, or similar device) through its browser. Cookies may also be installed by third parties with whom the controller collaborates.

c) Use of cookies on the website

The website uses two types of cookies:

• essential or technical cookies: these are cookies essential for the operation of the website, enabling good communication and they are intended to facilitate browsing
• statistical or analytical cookies: these cookies make it possible to recognize and count the number of visitors and to see their browsing behaviour when they visit the website. This improves the user’s browsing and makes it easier for him to find what he is looking for. The retention period for cookies varies according to their type: essential cookies are generally kept until the browser closes, while statistical cookies remain valid for up to two years.

II.8. Security

The CNUE shall implement appropriate technical and organizational measures to guarantee a level of security of the processing and the data collected with regard to the risks presented by the processing and the nature of the data to be protected appropriate to the risk. It takes into account the state of knowledge, the costs of implementation and the nature, scope, context and purposes of the processing as well as the risks to users’ rights and freedoms.

The CNUE always uses encryption technologies that are recognized as industry standards within the IT sector when transferring or receiving data on the website.

The CNUE has put in place appropriate security measures to protect and avoid the loss, misuse or alteration of information received on the website.
